These Terms of Service ("Terms") govern your access to and use of https://cyfox.tech (the "Site"), operated by Cyfox Inc. ("Cyfox", "we", "us"). By using the Site you agree to these Terms. If you do not agree, do not use the Site.

Use of the Site

The Site provides information about Cyfox services. You may browse and share its content for lawful purposes. You may not: (a) attempt to disrupt, overload, or interfere with the Site; (b) probe, scan, or test it for vulnerabilities without written authorization; (c) submit the contact form by automated means or with false information; (d) scrape or republish substantial portions of the Site's content for commercial purposes without permission; or (e) use the Site in violation of applicable law.

All content on the Site — including pricing ranges, timelines, processes, and service descriptions — is general information, not an offer, quotation, or professional advice, and may change without notice. Client engagements are formed exclusively through individually signed written agreements (such as a master services agreement and statements of work), which control over anything stated on this Site. Past results described on the Site do not guarantee future outcomes.

Intellectual property

The Cyfox name, logo, wordmark, and all content, design, and code of the Site are the property of Cyfox Inc. or its licensors and are protected by applicable intellectual-property laws. No license to them is granted by your use of the Site. (Terms regarding client work-product IP — which is assigned to the client — are defined in signed engagement agreements, not these Terms.)

Third-party services and links

The Site may reference or link to third-party websites and services. Cyfox does not control and is not responsible for their content, availability, or practices. References to third-party platforms or technologies do not imply endorsement or affiliation.

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY. Nothing on the Site constitutes legal, financial, or professional advice.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYFOX WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SITE. CYFOX'S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS (US $100). Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you. For clarity, this section applies to use of the Site only; liability in client engagements is addressed in the signed agreements governing those engagements.

Indemnification

You agree to indemnify and hold harmless Cyfox Inc. and its officers, employees, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or violation of these Terms.

Changes to these Terms

We may update these Terms from time to time. The current version, with its effective date, will always be posted on this page. Continued use of the Site after changes constitutes acceptance.

Governing law and venue

These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to their jurisdiction.

Severability

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
